Caleb’s Car Care

1. Customer-Initiated Repairs Policy

At Caleb’s Car Care, we understand that some vehicle repairs may start as DIY projects. However, if a repair becomes more complex or exceeds your skill level, our technicians can step in to complete the job. In these cases, our billing follows a Straight Rate structure, and no warranty is provided on work initiated by the customer.

1.1 Straight Rate Billing Definition

  • Timing: Straight Rate billing begins when the technician receives the vehicle keys and starts work. A stopwatch is used to track the actual time spent diagnosing or repairing the issue.

  • Billing: The time on the stopwatch is recorded once the service is complete and billed to the customer accordingly.

  • Scope: Straight Rate billing applies to all repairs that customers have partially started and require professional completion.

2. Warranty Exclusion

  • No Warranty: Repairs initiated by the customer and subsequently completed by Caleb’s Car Care technicians do not carry any warranty. This policy applies to labor and any parts provided by the customer or Caleb’s Car Care.

2. Appointments and Cancellations

  • Scheduling: Appointments must be scheduled in advance through our website, by phone, or by text.

  • Cancellations: To cancel or reschedule an appointment, please notify us at least 24 hours before the scheduled time. Cancellations made within 24 hours may incur a fee.

  • Late Arrivals and No-Shows: If the client is unavailable at the designated time and location, we may assess a service fee of .5 hours flat rate labor for the technician’s time.

  • IF ANY PART OF THIS TERMS OF SERVICE CONFUSES OR CONCERNS YOU PLEASE CALL OUR REPRESENTATIVE TO DISCUSS THE INTENT OF THIS TERMS OF SERVICE.

  • OUR GOAL IS TO PROVIDE MUTUALLY AGREED-UPON TERMS OF SERVICE THAT PROTECT THE CUSTOMER AND THE BUSINESS. WE DO NOT TRY TO HIDE POLICIES NOR DECEIVE CUSTOMERS

Authorization

1.1 customer hereby certifies that they have the legal authority and capacity to

contract, authorize, and compensate for repairs for the above-listed vehicle, either through legal ownership, lease rights, or written authorization from the vehicle's owner. customer authorizes Caleb's Car Care and its employees to take the steps to perform and complete the repairs listed in this contract, including on-road vehicle testing.

1.2 customer hereby certifies, grants, conveys, and allows Caleb's Car Care and its employees access to the property on which the repair is being completed. This includes authorization by landlords, apartment complex, building management, and Homeowner Association’s and affirms that Caleb's Car Care has legal permission to enter, occupy, use the space required for above listed repairs and legal permission to perform, maintain, and operation repairs at that space and time.

Payment

Payment

​customer agrees to pay x$ in full for the repairs and diagnosis described above upon successful completion of all listed auto repairs or diagnosis before receiving the vehicle’s key from Caleb's Car Care. customer agrees to pay for all parts, labor, fees, taxes, and other charges stated in this work order and is liable for the amount stated by the total.

Additional Performance

3.1 During performance of any repairs authorized by customer other components may be found to be faulty. If such components must be removed or touched during the performance of any repairs authorized by customer Caleb's Car Care will inform the customer of any potential additional cost that may be incurred to modify, continue, or cease repairs.

3.2 If needed, Caleb's Car Care will provide an updated invoice or written receipt for any payments made to this work orders effect. Payment must be made in full before the vehicle will be returned to customerl. Caleb's Car Care will not perform any repairs outside of those listed in this contract without prior written authorization from customer.

Diagnosis

4.1 Caleb's Car Care Diagnosis process progresses through as follows:

Vehicle diagnosis: Our technicians evaluate the vehicle and test any components deemed related to the concern of the client.

4.2 Caleb's Car Care does not deduct cost of diagnosis from total cost of repairs. Diagnosis is a money back guarantee service. If Caleb's Car Care recommendations for correction of concern are strictly followed and the concern is not corrected, then the cost of diagnosis is refunded. The customer will be made aware if replacement of a component is necessary to correctly diagnose a concern and this form will be notated to that affect. IF DIAGNOSIS IS NOT PERFORMED BY CALEB'S CAR CARE TECHNICIANS, THEN THIS SERVICE DOES NOT APPLY.

Insurance

5.1 In the event that an insurance claim is filed by customer related to the repairs performed, Caleb's Car Care will create an insurance estimate for submission to the insurer. This estimate is intended for internal use by the insurer for purposes of validating the insurance claim and reserving funds for payment at the conclusion of repair services.

Communication with Insurers

6.1 customer acknowledges that Caleb's Car Care has no formal relationship or obligation to any insurer. Caleb's Car Care's sole obligation is to customer, and performing safe, timely, and complete repairs is the first priority. customer acknowledges that Caleb's Car Care is not obligated to communicate with or assist insurers or their agents, including accepting cost estimates from insurers or allowing their agents into shop facilities for any reason.

Non-OEM Parts

7.1 customer acknowledges that any repairs using parts not made by the vehicle's manufacturer (commonly known as "aftermarket parts") may lead to the following:

  • Lease or Finance Violation: Some lease and finance contracts require the purchaser or lessee to make repairs using only original manufacturer parts ("OEM Parts"). Aftermarket parts used in repairs may violate these contracts.

  • Decrease in Value: Repairs made using aftermarket parts may lead to increased depreciation and lost vehicle value.

  • Manufacturer Warranty: Some vehicle manufacturers require that all repairs be made using only OEM parts. Use of aftermarket parts may void vehicle warranties.

7.2 In recognition of the above considerations, Caleb's Car Care shall not use any parts for repairs unless those parts are approved by customer. customer agrees and acknowledges that the above risks have been considered and acknowledged and has approved of the chosen parts for necessary repairs. Caleb's Car Care reserves the right to exercise professional judgement and refuse to make repairs using parts which are deemed inadequate or unsafe. Owner shall be solely responsible for the proper operating condition of each vehicle after repairs performed by Caleb’s Car Care.

Labor Warranty

8.1 Caleb's Car Care shall provide a limited warranty covering the workmanship of the repairs performed under the terms of this auto repair contract. This warranty shall last for a period of one calendar year from the completion of authorized repairs. During the warranty period, Caleb's Car Care will, at its sole cost and expense, correct any defects in workmanship related to the repairs performed in relation to this contract. This warranty covers labor only unless otherwise stated in the parts cost section of this contract. Any and all labor warranty are invalidated if any of the repairs utilize aftermarket parts or parts provided, produced, delivered, requested, or brought by customer. If the vehicle is not diagnosed by Caleb's Car Care no warranty on labor applies. Warranty must be submitted via email to us at 210calebscarecare@gmail.com.

Binding Contract

9.1 This contract shall be considered binding upon both parties and their assignees or successors, including subsequent title holders for the vehicle being repaired.

Additional Services

10.1 No services outside of those described in this auto repair contract will be performed by Caleb's Car Care without prior written approval from customer. If additional services or repairs are requested before or during the time of repair those services or repairs will be noted on this form. A resigning of this form may be required.

Additional Services

11.1 This agreement creates a license to operate and touch the vehicle as needed and in no way or form creates a bailment or duty to protect, secure, or defend any property. Caleb's Car Care shall not be held liable or responsible for any theft of property, damage of property, Acts of God, foreseeable or unforeseeable harm caused to the vehicle, the vehicle’s parts, or any parts owned by customer or Caleb's Car Care while performing, maintaining, or securing the vehicle for repairs. This includes vehicles left overnight(s) on stands, jacks, on the street, for repairs, diagnosis, or recommended by Caleb's Car Care. Additionally, this provision extends to parts, tools, equipment, and chattel in the possession of Caleb's Car Care including holding parts and overnight storage in work vehicles, warehouses, or other locations utilized by Caleb's Car Care.

Entire Agreement

12.1 This contract represents the entire legal agreement between Caleb's Car Care and customer. No other promises or arrangements, oral or written, outside of this contract and subsequent repair authorizations shall be considered valid.

Penalty for NonPayment

13.1 Caleb's Car Care shall not release the above listed vehicle keys until customer has made full payment for all services performed by Caleb's Car Care.

13.2 In the event that auto repair services rendered are not paid for within 14 days of completion, Caleb’s Car Care may incur expenses, or utilize counsel to enforce any obligations owed under or arising from this agreement including repossession or filing of a mechanic’s lien.

TO THE FULLEST EXTENT ALLOWED BY APPLICABLE LAW, OWNER HEREBY WAIVES THE RIGHT TO JURY TRIAL.

14.1 If a dispute arises out of or relates to this contract, or the breach thereof, and if the dispute cannot be settled through negotiation, the parties agree first to try in good faith to settle the dispute by mediation administered by the American Arbitration Association under its Commercial Mediation Procedures before resorting to settling all remaining claims by arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. All mediation and/or arbitration shall take place in Bexar County, Texas, utilizing the laws of Texas.

Severability

15.1 If any provisions of this Contract shall be held invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If a court finds any provision of this Contract invalid or enforceable, but by limiting such provision it would become enforceable or valid, then such provision shall be written, construed, and enforced as so limited.

Waiver of Contractual Right

16.1 The failure of either party to enforce any provision of this Contract shall not be construed as a waiver or limitation of that party’s right to strictly enforce every provision of this Agreement.

Customer Approval

By signing below, customer indicates approval of the services and rates listed in this automotive repair contract. Likewise, they agree to the full terms and conditions of this contract without exception.

At Caleb’s Car Care, we prioritize professionalism, safety, and respect in every interaction with our customers. These Rules of Engagement outline the standards our technicians uphold to ensure a consistent, respectful, and safe experience for both customers and our team members.

1. Professional Boundaries

  • Restricted Access: Technicians are NOT permitted to enter a customer’s home or domicile under any circumstances. All services are performed outside or in customer-approved workspaces that are accessible without home entry. This ensures the privacy and safety of both customers and technicians.

  • Food and Drink Policy: Technicians are NOT permitted to accept food or beverages from customers. This policy is in place to prevent risks associated with tampering and ensures technicians maintain focus and professionalism while on the job.

2. Respectful and Professional Conduct

  • Customer Respect: Our technicians are trained to interact with customers respectfully and courteously at all times. We approach every service as if we were assisting a family member, addressing concerns with genuine care, patience, and attention to detail.

  • Clear Communication: Technicians are committed to clear, honest communication. They will keep customers informed about the status of the service, explain any issues or additional findings, and provide transparent recommendations.

3. Safety and Accountability

  • Safety First: Technicians follow all safety protocols to ensure a secure work environment. This includes assessing the service location for potential hazards and ensuring that all tools and equipment are safely handled and secured.

  • Customer Satisfaction: We aim to address all customer concerns effectively. Technicians will thoroughly explain the service performed, answer any questions, and provide tips for ongoing vehicle care.

4. Zero Tolerance for Unprofessional Behavior

  • No Solicitation: Technicians are not permitted to solicit tips, personal business, or referrals from customers. All service requests and follow-ups should be managed through Caleb’s Car Care official channels.

  • Non-Discrimination: We do not tolerate discrimination in any form. Our technicians treat all customers equally, regardless of background, and strive to make every customer feel valued and respected.

5. Privacy and Confidentiality

  • Confidentiality: Any personal or vehicle information shared with our technicians is treated with strict confidentiality and used solely to complete the service requested.

  • Respecting Customer Property: Technicians will treat all customer property, including the vehicle and surroundings, with respect and care, ensuring no damage or unnecessary disruption occurs during service.
